This case note reviews Sinclair v. EPA. The Tenth Circuit Court of Appeals concluded that the Environmental Protection Agency (EPA) exceeded its congressional authority in its interpretation of "disproportionate economic hardship" into the Renewable Fuel Standards (RFS) program exemption extension review process.
